Terms of Service

You retain full ownership of all photos, videos, and other content you upload to StayProof (“User Content”). We do not claim ownership of your User Content.

By uploading User Content, you grant StayProof a limited, non-exclusive, worldwide, royalty-free license to store, process, display, and analyze your content solely for the purpose of providing the service to you. This license ends when you delete your content or close your account.

You represent that you have all necessary rights to upload the content and that your content does not violate any third-party rights, laws, or regulations.

Your limited license to StayProof allows us to:

• Store and serve your uploaded photos and files to provide the inspection report service.
• Process photos through AI analysis to generate property condition reports and classifications.
• Display your content to you and to people you explicitly share your reports with.
• Use de-identified and aggregated data (from which individual users cannot be identified) for product analytics, service improvement, and AI model development.

We will not use your identifiable photos or videos to train AI models unless you give explicit opt-in consent in your account settings.

StayProof uses artificial intelligence, including third-party large language models, to analyze uploaded photos and assist in generating property condition reports. AI-generated observations may be incomplete, inaccurate, or miss details that would be identified by a licensed professional inspector.

You are responsible for reviewing, confirming, or correcting all AI-generated content before relying on any report. Reports should not be used as a substitute for a professional inspection.

You agree to:

• Use StayProof only for lawful purposes and in compliance with these Terms.
• Not upload content that is obscene, defamatory, or infringes third-party rights.
• Not attempt to reverse-engineer, scrape, or disrupt the service.
• Keep your account credentials secure and notify us of any unauthorized access.
• Ensure that any photos you upload are taken by you or that you have the legal right to share them.

StayProof reports are provided for documentation and evidence-organization purposes only. Nothing in a StayProof report constitutes legal, insurance, engineering, appraisal, structural, or other professional advice.

Do not use StayProof reports as a substitute for a licensed property inspector, lawyer, insurance adjuster, or engineer. Always consult qualified professionals for decisions that have legal or financial consequences.

StayProof offers free and paid plans. Paid plans are billed through Stripe. By purchasing a plan, you agree to Stripe's terms and authorize the applicable charges.

Subscription fees are non-refundable except where required by applicable law. One-time report credits do not expire.

We reserve the right to change pricing at any time. Changes to subscription pricing will be communicated with reasonable notice before your next billing cycle.

You may delete your account at any time from your Account settings page. Upon deletion request, we will process the removal of your personal data and User Content within a reasonable timeframe, subject to legal retention requirements.

We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice.

To the maximum extent permitted by applicable law, StayProof and its affiliates, officers, employees, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising out of or in connection with your use of the service.

Our total liability to you for any claim arising from these Terms or your use of the service will not exceed the amount you paid to StayProof in the twelve months preceding the claim.

These Terms are governed by the laws of the Province of British Columbia, Canada, without regard to its conflict-of-law provisions. Disputes will be resolved in the courts of British Columbia.

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the “Last updated” date. Continued use of the service after changes constitutes acceptance of the revised Terms.
